Welcome to Emma Darlington Ltd. These are the terms and conditions which apply to any purchases of clothing accessories or other goods you make from Emma Darlington via the website www.emmadarlington.com.

The Website and Goods are provided by Emma Darlington of Emma Darlington Limited registered in England & Wales under Company number 9138987 with its Registered office at Mulberry House, The Street, Whiteparish, Salisbury SP5 2SL

When reference is made to ‘you’ and ‘your’ this refers to the user of the site and purchaser of the goods. When reference is made to ‘we’, ‘us’, ‘our’ this refers to Emma Darlington and her team.

 PART 1: RELATES TO INFORMATION ABOUT THE WEBSITE.

We will try to ensure that all information given on the website including descriptions and listed prices, are accurate and correct. In the event that a mistake is made, we will try to resolve all mistakes and errors on the site as soon as possible. In the event that such a mistake affects goods that you have purchased via the website, we will do all in our power to let you know. However because we take these steps we all not be liable to you for any mistakes or errors made on the website.

 PART 2: BUYING GOODS:

Please bear in mind that shopping from a website is a different experience from buying in store. Particular attention should be taken of the following:

  1. All sizes given for garments are approximate.
  2. All goods are subject to availability and take up – so we may not always be able to fulfill your order.
  3. Delivery dates given on the website are estimates only.
  4. Colours shown on the website may vary depending on the equipment being used to access the site [ I.e. Mac book versus mobile phone applications.]

We ask that you ensure that all of your login details and passwords relating to your account remain confidential at all times.

 BUYING OF GOODS FROM OUR WEBSITE:

You be deemed to have made an offer to purchase from us when your order is placed via the website as set out below: 

  1. A) You add the product to your basket
  2. B) Check out step 1- Login details,
  3. C) Checkout step 2- Address details
  4. D) Checkout 3 – details of a contact Tel number and email address
  5. E) Checkout step 4:Payment details
  6. F) Checkout stage 5: You confirm the order

Your order only constitutes an offer to purchase and will not form a binding contract until, it is accepted by us.

On receipt of your order, we will send you an order acknowledgement email, to the address provided by you at Checkout stage 3 above.

This will contain your order number, details of your order and an estimated delivery date. This email serves to let you know that your order has been received, and is not acceptance by us of any offers to purchase goods. Before this can happen we must receive full payment of the price of the goods before we can accept the offer. Where payment is being made by credit or debit card, payments will only be processed at the point of preparing goods for dispatch.

An offer will only be deemed accepted once goods are dispatched to you and a dispatch email has been sent. We reserve the right to refuse any offers in an order prior to acceptance.

 

WHERE GOODS YOU REQUIRE ARE NO LONGER AVAILABLE:

Where products from the website are unavailable you will be advised by email. Where multiple items are being purchased, a product which is not available, will not be included in the contract for those others products being dispatched.

 

PRICES ON THE WEBSITE: FOR UK CUSTOMERS:

All prices shown on the Website are UK pounds Sterling.

Delivery price options will be as stated on the site and these may be subject to changes from time to time.

Prices listed on the website are unless otherwise specified inclusive of the current given rate of VAT.

 

WHERE ORDERS ARE PLACED BY OVERSEAS CUSTOMERS:

  1. The credit card companies and/or banks will determine the exchange rates given and may add on processing or administrative fees if the order has to be converted from another currency to UK pounds sterling.
  2. Prices listed on the website are unless otherwise specified inclusive of the current given rate of VAT.
  3. Please note that we may be restricted by law or regulatory restrictions, from delivering some of our products to non - UK destinations.
    Some countries have restrictions on the imports of certain products or materials, and it is the customer’s responsibility to make necessary checks before placing your order.
  4. For orders made outside the UK, it is the customer’s responsibility to make all payments in connection with Import duties and /or other taxes to relevant Customs /Tax authorities.
    For more information on this, we suggest that you contact your local Customs office.
  5. Please note we are unable to process VAT refunds for International Customers.

 

PART 3: RETURNING GOODS:

This section deals with your rights to return goods that you do not want to keep.

You can at any time within 28 days of receiving goods from us cancel your contract and return goods to us, subject to the following conditions:

  1. All tags , labels and packaging should remain on the garment
  2. The garments should not have been worn or laundered.

Please note this will not apply in respect of Sale items, in which case we will give credit notes for the same value to be used for other items within the Emma Darlington Collection, which will remain valid for 6 months.

When we deliver goods to you, we include a returns slip and information as to how to return goods to us.

To return goods you must complete the returns slip and enclose this with the items you are returning. These should be put into the pre addressed returns plastic envelope and sent back to

PART 4: GENERAL TERMS RELATING TO OUR RELATIONSHIP WITH YOU:

We will not be held responsible for the performance of obligations under these terms and conditions in the case of an event outside of our control. Such as force majeure, strikes, failures of 3rd party systems or networks, acts of God (fire, earthquake, storm, flood or other natural disaster), civil unrest, terrorism, sabotage or malicious damage caused in any area pertaining to or affecting this contract.

We want your shopping experience with Emma Darlington to be a positive one and will do our best to ensure that all of the information on the website is accurate and up to date. However we cannot warranty the accuracy of the information and cannot be held liable for any interpretation you put on it unless specifically agreed in writing with us beforehand.

 

PART 5: SPECIAL OFFERS, COMPETITIONS & PRIZE DRAWS:

Each offer made on the website may not be used in conjunction of any other offer.

The offers will only be available on line,and be for the time limit specified within the offer.

Such offers are only available to UK residents over the age of 18.

Emma Darlington reserves the right to amend or discontinue such offers at any time.

Winners will be selected randomly and notified by email and our decision will be deemed final .Your statutory rights are not affected.
